• The data we collect

  
  To avail certain services on the Wafeer App, users are required to provide access to your phone's SMS inbox records, location, device ID, device name, device model and any other such information as required. The Information as supplied by the users enables us to improve the Wafeer App and provide you the best app experience. All required information is service dependent and the Company may use the above said user Information to maintain, protect, and improve the Wafeer App Services and for developing new services.
  Personal Information:
  Wafeer does not explicitly ask for any kind of personally identifiable information such as Name, Email address at the time of installation. However, such information could be made available to us either (1) explicitly by you for the purpose of contacting the company or (2) in process of using third party services such as or Google play store for subscription payment. Such information may also be present in SMS sender name or SMS text, But Wafeer does not extract this information to create your profile. Any personally identifiable information made available to the App will not be considered as sensitive if it is freely available and/or accessible in the public domain. Further, any reviews, comments, messages, blogs posted/uploaded/conveyed/communicated by users on the public sections of the Site or an Application Store (like the App Store or Play Store) becomes published content and is not considered personally identifiable information subject to this Privacy Policy. We will not be liable and or responsible for the denial of certain services to you for lack of you providing the necessary personal information. Further if the personal contact information is made available to the company, we may contact you from time to time about any topic that we believe may benefit/interest you.
  SMS Inbox Information:
  User can enable automatic transactions reading for the purpose of providing automated expense tracking service, it’s optional feature and Wafeer reads the text messages (SMS) sent by providers of services only for banks sender names that user selected in the app. No personal SMS are read by the App. Your explicit consent is taken before reading SMS Inbox of the mobile device at the time of enabling the feature.
  SMS transactions Uploading:
  Wafeer uploads only purchase SMS transactions with the banks sender names that user selected in the app.
  Wafer only uploads and reads purchase messages to analyze and categorize it and your data is not shared with any party
  The use of the data you provide to us in Wafeer application is limited to the purposes of following up and managing your budget, the individual's monthly and annual spending, and to provide information that helps the individual manage his expenses and the overall improvement of the application.
  Other Information:
  In addition, the Application may collect (either directly or through third party integrated services such as Google Analytics, Facebook android SDK etc.) certain information automatically, including, but not limited to, the mobile device model, device name, device's serial number or unique identification number (e.g. Android ID or ADID on your Android Device), device operating system & version etc. and information about the way you use the Application. This information is only used to improve the Application & the service.

• USER RIGHTS FOR DENIAL OF PERSONAL INFORMATION

  
  User may choose to deny the SMS permission, location permission and use of third-party backup service. Each of these actions would impact some functionality of the App but it will continue to perform other functions.
  However, the services such as the subscription payment on Google Play store is mandatory and App will stop working after the trial period if the subscription is not activated.
  Users may at any time stop collection of information by the Application by uninstalling the App. User may use the standard uninstall processes as may be available as part of mobile device or via the mobile application or network.

• PURPOSE OF INFORMATION COLLECTION

  
  This information can be used by us to maintain, protect and improve the services provided by the company or for developing new services. You also consent to the information obtained to be used in order to contact you for administrative purposes such as customer service, notification of major changes and updates etc. Wafeer may also use the information related to user spends, patterns and user data to generate anonymized and aggregated statistics & reserves the right to this statistical data.
  Any personally identifiable information available in the public domain, reviews, comments, messages or emails etc. posted/sent by users becomes published content and is not considered personally identifiable information subject to this Privacy Policy.

Note that, no money can be moved through this App. This means that even though you can view accounts, analyse expenses and transactions, you or the App cannot transfer money from one account to another

  Wafeer application is a service that helps individuals to follow up and manage the individual’s budget, monthly and annual disbursement by using the bank transactions that the individual make and collecting that data to provide information that helps the individual manage his expenses. By downloading the application, registering your data, and using the services provided by Wafeer application (“Services”), you agree to the terms and conditions, the privacy policy, any policies set by the company for Wafeer application or what serves the application, and any modifications that has been made to it from time to time and in accordance with the items of these terms and conditions
  The company reserves the right, on its own volition, to make any modification , addition or deletion of any item of these terms and conditions at any time without notice. This page will be updated with an indication of the last update date (release date ) of the terms and conditions. By continuing to use the application, you agree to the updated terms and conditions, and the terms and conditions constitute a legal commitment between you and the company.

  The services provided via Wafeer application are dedicated for individuals as a natural and not legal person, and it is not permissible to use, sell, copy or transfer any of our services to any third party. Also legal persons may not use the application for any purposes that are not compatible with the services provided by the application or these terms and conditions.

• Ownership and licensing rights

  
  Ownership of all service content, details, designs and structure (including: user interface, data, information, statistics, and any data resulting from your use of the application) will be vested in the company and the rights arising from it with the exception of your personal information. By agreeing to these terms and conditions, you agree and confirm that the application and services contain materials reserved in intellectual property rights laws and you acknowledge that the company is the sole and exclusive owner of all rights, addresses and interests associated with the application or its content or both, including any patents, trademarks, design rights and Copyright and any other intellectual and industrial property rights associated with it and has the right to dispose of them without reference to you.
  You also acknowledge and agree not to take any actions that conflict with this ownership, and if you take any derivative actions that violate any of the rights of the company based on what is stated in these terms and conditions on the application or its contents, in whole or in part, then you unequivocally and automatically entrust the company with all rights and exemption of the company from any claims or obligations towards others, and the company reserves its right to take the necessary legal actions.
  Under these terms and conditions, the company grants you a personal, limited, non-exclusive, and non-transferable license to do the following: (1) download, log on to and use the application, including any updates made to it in symbolic format for the target on a single mobile device; And (2) accessing and using the content, including any updates or improvements made to it only on your mobile device, in accordance with these terms and conditions.

  The logo and word "Wafeer " and any graphics, designs, logos, page headers, icons or application fonts are within the trademark owned by the company in the Kingdom of Saudi Arabia and in any other country. The company's trademark may not be used, copied, or associated with any product or service in any way which constitute any confusion without the prior written consent from the company.
  

• Wafeer application services

  
  The company has the right at any time during the period of your use of the application to refrain from providing part or all of the services mentioned above . Also the company can add services to the application and / or define general practices and impose restrictions on the use of services without notifying you in advance
  The application services are based on the availability of the Internet service, and therefore you must provide the Internet service and it must work well and the network connectivity must be continued to obtain the features that we provide.
  The application is not responsible for any delay or inability to access to the application services arising for any reasons related to poor internet service or your failure to provide a suitable device to access to the application.
  The application is not responsible for any illegitimate operations that may hinder your access to the application, and you must secure the device used to access to the application well to ensure that your information is protected.
  

• User contents for the service

  
  The company acknowledges that your account, transactions, statistics of your purchases, and any information derived from you from time to time in your use of the application (“User Contents”) remain yours and are only used for the purpose of providing you with the highest levels of service in a manner that does not conflict with these terms and conditions. You reserve the copyright and any other rights owed to the user's contents . By entering user data and contents, you agree and grant the company a non-exclusive, free, global, irrevocable, permanent, transferable license to use, distribute, reproduce, develop, display and perform in general and exploit these inputs related to the service provided. Your account, transactions and purchase statistics are published and can only be accessed to through your account.
  If you can add the content through Wafeer application, then you guarantee and acknowledge that this content is legal and does not conflict with any regulations applicable in the Kingdom, and you also acknowledge that you are the authorized person to provide this data through the application and that this data is not specific to others and is not subject to any rights that prevent it from being added to the application. You are fully responsible for all information, data and content that you provide through the application.

• Subscriptions Policy

  
  Currently, all services in Wafeer application are free, and you will receive additional services except for the free services provided , the company imposes a subscription fee during the period of your use of the services (“subscription fees”). The period of your subscription to the service may be one or twelve months, depending on the value of the subscription fee.
  You agree to provide the company with an active credit card with sufficient balance to cover the subscription fees. You give authority and authorize the account of that credit card to pay any amounts described here and you give authority and authorize the company to take the amounts described here from the account of that credit card.
  The subscription fees depend on the service provided. The company reserves its right to adjust the subscription fees at any time and the mechanism for paying the subscription fees.
  Subscription fees are deducted from your account in advance or periodically. Noted that the subscription fees are not refundable and you don’t have the right to claim the company for recovering the subscription fees for the period or parts of the period in which you did not use the service. You bear all fees, expenses, local taxes, disbursement fees, and any other fees and expenses of any kind, except for taxes of the company's income.



• Termination and expiry of the period

  
  All services provided in Wafeer application are provided periodically through Apple App Store and Google Play. Periodic subscriptions are automatically renewed unless you terminate or cancel the subscription.
  You can cancel any of the services provided in Wafeer application at any time through the subscription page in your account and follow up the guidelines to cancel the services. Your cancellation of any of the services produces an immediate effect after the expiry of the subscription period. When you cancel any of the services, the company does not deduct any subscription fees in the billing cycle that follows the cancellation.
  Cancellation of any of the services may cause you to lose the contents of your account and your access to the account. Cancellation and termination of your account leads to the loss of all your account contents and your access to the account. This information cannot be retrieved and the company does not bear any responsibility against you for losing those information.
  Without prejudice to what is contained in these terms and conditions, we may terminate these terms and conditions and your use of Wafeer application or part of the services provided by the application for any reason and at any time. Without limiting the scope of the previous paragraph, we may suspend the service and block access to your account in the following cases:
  
  • If you violate the provisions of these terms and conditions ,
  • Or we see that you will expose us to unacceptable credit or fraudulent risks,
  • If it turns out that you provide or that you have provided us with false, incomplete, incorrect or misleading data (including but not limited to registration data) or that you are involved in fraud or illegal conduct
  • Or if we have security concerns about your account, including your credentials,
  • If we suspect unauthorized or fraudulent use of your account.
  In such cases, we will inform you of the suspension of your account and the reasons for that, if possible, before the suspension and at the latest after the suspension immediately, unless we see at the time that giving such information may cause security problems or if the applicable law prohibits that, and we will reactivate or replace your account or your credentials, as the case may be, once the reasons for suspension are no longer exist.

• Close your account

  You acknowledge and agree to the company's right to close your account in the following cases:
  • In the event that the account while its opening face identity verification problems via the service of data matching with official records.
  • Trying to use the application illegally.
  • The client has violated any of the items or obligations contained in these terms and conditions.
  
  When you wish to close your account, you can do so through the application or submit to the Customer Care Department in a manner that does not conflict with the provisions contained in these terms and conditions.
  

• Statutory responsibility and compensation

  
  You agree that you will be personally responsible for your use of the service and agree to protect, exempt and absolve the company, its employees, managers, workers in it , consultants, followers, subsidiaries and clients from and against any and all lawsuits, responsibilities, damages, losses and costs - including attorney and accounting costs - that may arise from you, or associated with: (1) Your log on to , your / alleged use of the service. (2) Your breach of the Terms of Service or any statement, guarantee or agreements mentioned here. (3) Your breach of any rights of a third party, including - but not limited to - any intellectual property rights, propaganda and advertising rights, secrets, the right to ownership or privacy. (4) Any complaint or allegation by a third party the company transfers to you to the extent based on any real or alleged act or negligence on your part and on your side, or any lawsuit or allegation resulting from that transfer. (5) Any disputes or problems between you and any service provider or third party. We reserve the right - at our own expense - to assume the defense and control of any matter susceptible to compensation by you, and in that case you agree to cooperate with our defense of that lawsuit and you undertake not to interfere in any lawsuit without the prior written permission of the company.
  

• Responsibility limits

  
  You agree and acknowledge that the company, its subsidiaries, its employees, managers , workers in it , consultants, followers and clients will not be responsible against you for any damages - direct, indirect, accidental, special, or with consequences or punishable by the law - caused by your use of the service or your inability to use the service.
  You agree that the company is not responsible for any slanderously , hostile or unlawful behavior caused by service providers, other users, or third parties, and that the risk of dealing with the mentioned ones lies upon you. We are not responsible for your reliance on information provided by a service provider or through the service, and you must ensure that such information is correct, accurate, complete and appropriate for you. You are responsible for dealing with the service provider to determine the nature and size of each order and to ensure that such order complies with all applicable regulations.
  You agree that the maximum total responsibility of the company against you as a user for any and all lawsuits arising from the use of the service or associated with it is limited to the following: (1) The amounts you paid to Wafeer application in exchange for logging on to and using the service during the six months (6 months) preceding the event that occurred that led to the lawsuit.



• General Provisions

  
  We may modify the items of these terms and conditions, specifications, or any policy or features of the application services at any time, however, we will provide you with a notice of no less than thirty (30) days before applying of any changes or any shorter period if the modifications are based on government decisions or new laws, or if we deem it necessary to modify these conditions within a shorter period, and the matter is ultimately subject to the company's viewpoint. We will inform you of any modification to these terms and conditions or any policy by publishing it on our application. In the event that you do not agree to any change to these terms and conditions or specifications or to any policy or feature of the application services, you may terminate the terms and conditions and close your account without imposing fees on you in relation to the termination. You will be considered agreeing to changes in policies or specifications or these terms and conditions if you do not terminate your use of them by the date that corresponds to the end of the thirty (30) days period from our notification to you of the change or any shorter period that we specify and you are always responsible for reading and understanding each version of these terms , conditions and our policies.
  These terms and conditions may not be interpreted as they establish or seeking to establish any joint venture or relationship between a worker and an employer, an escrow account, a partnership, or any financial relationship between you and us or any of our affiliated entities. Nor may any party be considered an agent or representative of the other party under these terms and conditions. Also neither party has been delegated nor may any party seek to create or assume any obligation or explicit or implicit responsibility in the name or on behalf of the other party. Without limiting the generality of the foregoing, it is not permissible for any party to conclude any contract, agreement or commitment that would provide any guarantee, bail, create or assume any obligation or responsibility on the name or on behalf of the other party.
  You may not conclude any waiver or transfer of any of the rights, obligations, or privileges that you obtained under these terms and conditions without our prior written consent to that, and taking into account the foregoing, these terms and conditions are binding on those who succeed the parties in the right and have not waived them. Any waiver concluded in violation of the provisions of this clause shall be void.
  

• Confidentiality

  
  The company acknowledges that your personal records (your name and identity) are confidential documents and therefore they will not be disclosed to any third party other than the employees and to the competent authorities in the event that the legal situation requires this.
  The company will not sell, share, or rent your personal information to any third party or use your e-mail to send unwanted messages without conflict with these terms and conditions. Any e-mails sent by Wafeer application will be associated with the services and products provided and agreed upon.

You acknowledge and agree in the event that any of the company's rights and obligations are transferred to the entitlement of the company to which the rights and obligations are transferred to continue to provide services and your use of the application in accordance with these terms and conditions and the privacy policy.
  

• Waiver

  
  Any waiver made by any party of its rights or the obligations of the other party stipulated in these terms and conditions will not be taken into consideration unless the waiver is in writing and signed by the waiving party. The failure or negligence of any party to enforce or impose the implementation of the provisions of these terms and conditions or in the use of its rights or compensation under these terms and conditions is not considered a waiver or giving up of its right to establish or rely on those provisions, rights or compensations, but all of them remain valid and productive for all legal implications.ns.
  



• Nullity

  
  If it turns out to any competent court that any part of these terms and conditions is nulled or unenforceable, the remaining parts of the terms and conditions remain in effect and produce all their legal effects, and the court shall interpret (at our request) the nulled or unenforceable part in a way that preserves the possible extent of the intent expressed in the original language of the terms and conditions. If the interpretation is not possible in this way, the relevant part of these terms and conditions shall be deleted, and the remaining parts of them shall remain valid and produce all their legal effects.

  These terms and conditions are subject to the laws applicable in the Kingdom of Saudi Arabia. Also these terms and conditions and all non-contractual obligations that arise from or related to them are subject to and interpreted in accordance with the laws applicable in the Kingdom of Saudi Arabia. Disputes arising from or related to these terms and conditions shall be adjudicated in accordance with the dispute settlement procedures applicable in the Saudi Arabian Monetary Agency from time to time.

• Approval of the terms and conditions

  
  Your use of the Wafeer application means your approval of these terms and conditions, and the controls and conditions governing the application. If you do not approve these conditions, you must refrain from using any of the services provided through the application without the slightest responsibility on the company.
  

• Electronic contract

  
  These terms and conditions and the privacy policy are an electronic contract between the application and its users, and all its clauses are binding on all users, and it is not permissible to breach any obligations contained in this contract or arising from its application.

• Electronic signature

  
  Your using of Wafeer application or any services available through it, registering an account with us, providing your data to us through the application or subscribing to any of our services, are an electronic signature on these terms ,conditions and the privacy policy that replaces any written signatures required.

  You agree to receive any legal notices under this agreement electronically or through the means of communication that you have provided us with, and these notifications are a substitute for any written notices that are required to be provided to the user.
